In the context of the recent Covid pandemic, the module will explore the principle of access to justice as central to the rule of law, and how unmet legal need can exacerbate health-harming inequalities. Students will engage with research on the challenges faced by underserved, disadvantaged and vulnerable groups in accessing and benefiting from legal services as a result of lack of knowledge about rights and entitlements, inability to pay for legal services, and decreasing supply of free sources of advice and representation. It demonstrates the connections between legal, social and health problems; the obstacles to getting legal advice and potential remedies offered through grassroots and strategic levels via courts and tribunals.

Rule of law , the mechanism, process, institution, practice, or norm that supports the equality of all citizens before the law , secures a nonarbitrary form of government , and more generally prevents the arbitrary use of power. Arbitrariness is typical of various forms of despotism, absolutism , authoritarianism , and totalitarianism. Despotic governments include even highly institutionalized forms of rule in which the entity at the apex of the power structure such as a king , a junta , or a party committee is capable of acting without the constraint of law when it wishes to do so.

Through customized trainings and capacity building for lawyers, judges, government officials, law professors, law students, civil society organizations and the public, ABA ROLI contributes toward the development of societies that can uphold and assert human rights.

The World Justice Project is launching a multidisciplinary initiative to expand knowledge of the relationship between public health and the rule of law, and to identify measures to tackle the twin crises of the COVID pandemic and the rule of law where they intersect. This essay provides an introduction and first step toward building a research agenda, sharing knowledge, and supporting efforts to recover and rebuild effective governance founded on the rule of law. The COVID pandemic strikes in the midst of a mounting global rule of law crisis in which respect for key principles of good governance has been eroding in many countries for a number of years. This new pressure on the rule of law and its risk of further erosion makes the pandemic particularly dangerous. At the same time, gaps in the rule of law risk worsening the COVID crisis and undermining our ability to respond effectively. The rule of law is a durable system of laws, institutions, norms, and community commitment that delivers accountability of both government and private actors, just laws that protect fundamental rights, open government, and accessible justice.

Justice Canada is working to advance a people-centered approach to justice that puts consideration of the individual at the heart of justice responses by providing access to information, programs and policies. Legal issues are often embedded in a cluster of other problems that can affect many areas of life, including housing, employment, education and health. This makes it very important to address these problems as early as possible. Timely access to a fair and effective justice system, as well as access to information, resources and informal service, will help support the wellbeing of individuals and communities. Human Rights and Access to Justice

Access to justice is a basic principle of the rule of law. In the absence of access to justice, people are unable to have their voice heard, exercise their rights, challenge discrimination or hold decision-makers accountable. The Declaration of the High-level Meeting on the Rule of Law emphasizes the right of equal access to justice for all, including members of vulnerable groups, and reaffirmed the commitment of Member States to taking all necessary steps to provide fair, transparent, effective, non-discriminatory and accountable services that promote access to justice for all [para. Delivery of justice should be impartial and non-discriminatory. In the Declaration of the High-Level Meeting on the Rule of Law, Member States highlighted the independence of the judicial system, together with its impartiality and integrity, as an essential prerequisite for upholding the rule of law and ensuring that there is no discrimination in the administration of justice [para. UN entities support Member States in strengthening justice in areas including: monitoring and evaluation; empowering the poor and marginalized to seek response and remedies for injustice; improving legal protection, legal awareness, and legal aid; civil society and parliamentary oversight; addressing challenges in the justice sector such as police brutality, inhumane prison conditions, lengthy pre-trial detention, and impunity for perpetrators of sexual and gender-based violence and other serious conflict-related crimes; and strengthening linkages between formal and informal structures. One of the major obstacles in accessing justice is the cost of legal advice and representation.
