The formal existence of the Organization was confirmed 4 April , once the Convention had been ratified by 26 States, including New Zealand. ICAO is a specialised agency of the United Nations, formed to promote the safe and orderly development of international civil aviation throughout the world.

Since COVID developed into a global crisis, scholars have argued about the possibility of suing China for its role in the spread of the pandemic see e. On the international level, scholars have identified several legal bases on which to pursue claims, most notably Arts. This is especially tricky in the case of China, which has historically been reluctant to accept compulsory jurisdiction of international courts. However, there might be an additional route to bring this issue to an international body and eventually even to the ICJ: the Convention on International Civil Aviation. This multilateral treaty, also known as the Chicago Convention, which entered into force in , sets up principles for the international operations of civil aircraft.

It seems that you're in Germany. We have a dedicated site for Germany. This book is both a repertory guide to the Convention on International Civil Aviation Chicago Convention as well as a legal analysis of the provisions of the treaty. Above all, the book offers a commentary on the functional and moral fabric of the Chicago Convention, which is not only a multilateral legal instrument that sets out basic principles of air navigation and air transport, but also serves as a moral compass that brings the people of the world together. The teleological nature of the Chicago Convention is reflected from the outset — from its Preamble which sets the tone and philosophy of the Convention — that aviation builds friendship and understanding among all people, to its technical provisions that range from rules of the air to landing at airports and customs and immigration procedures. The book effectively demonstrates the Aristotelian principle — that rules make people good by forming habits in them.

Aviation law is the branch of law that concerns flight, air travel , and associated legal and business concerns. Some of its area of concern overlaps that of admiralty law and, in many cases, aviation law is considered a matter of international law due to the nature of air travel. However, the business aspects of airlines and their regulation also fall under aviation law. In the international realm, the International Civil Aviation Organization ICAO provides general rules and mediates international concerns to an extent regarding aviation law. In the United States and in most European nations, aviation law is considered a federal or state-level concern and is regulated at that level. In the U.

Air law , the body of law directly or indirectly concerned with civil aviation. Aviation in this context extends to both heavier-than-air and lighter-than-air aircraft. Air-cushion vehicles are not regarded as aircraft by the International Civil Aviation Organization ICAO , but the practice of individual states in this regard is not yet settled. The earliest legislation in air law was a decree of the Paris police forbidding balloon flights without a special permit. Because of the essentially international character of aviation, a large part of air law is either international law or international uniform law rules of national law that have by agreement been made internationally uniform. Insofar as international air law is concerned, it need hardly be mentioned that an international agreement or an amendment thereto is binding only on states that are parties to it. A basic principle of international air law is that every state has complete and exclusive sovereignty over the airspace above its territory, including its territorial sea.
